General Provisions
These General Terms and Conditions of Sale (GTCS) govern the contractual relationships betweenImport Clément(hereinafter referred to as "the Seller") and any natural or legal person making a purchase on the siteClem-Tex(hereinafter referred to as "the Customer").
Any order implies unconditional acceptance of these GTCS.
Scope of Application of these GTCS
The products offered are described and presented with the greatest possible accuracy.
Photographs and descriptions are provided for informational purposes and are not contractual. Slight differences may exist without the Seller being held liable.
Pricing Terms
Prices are indicated in euros (€), all taxes included (TTC), VAT included according to current legislation.
The Seller reserves the right to modify its prices at any time, it being understood that the price applied is that in effect at the time of order validation.
Order Procedure
Any order placed on the site implies acceptance of these GTCS.
The order is considered final after:
payment validation
The Seller reserves the right to refuse an order in the event of a dispute or suspicion of fraud.
Payment
Payment is made by credit card or any other means offered on the site.
The order will only be shipped after payment validation.
Delivery
We pay special attention to each order by meticulously preparing your parcels. We use neutral and specially adapted packaging to ensure that your products travel safely and arrive in perfect condition.
Preparation Times
Orders are prepared within a timeframe of:
- 5 to 7 working days.
These times are given as an indication and may vary. However, we do everything possible to adhere to them.
These preparation times are in addition to the delivery times indicated below.
Delivery Times
Deliveries are made within:
- 3 to 7 working days in France
- 3 to 15 working days in Europe
The times are given as an indication and may vary depending on the carrier or external conditions.
Delivery charges are indicated at the time of order.
Limitation of Liability in Case of Delays
The Seller cannot be held responsible for delays related to:
carriers
weather conditions
exceptional events or force majeure
Liability
In accordance with the regulations applicable to distance sales, the risks are transferred to the Customer as soon as the parcel is delivered to the specified address.
Liability
The Seller cannot be held responsible for indirect damages such as:
- financial losses
- loss of revenue
- loss of data
- immaterial damage
The Seller cannot be held responsible in case of improper use of the products.
Non-delivery / delivery marked as completed
The Seller cannot be held responsible for parcels marked as delivered by the carrier.
It is the Client's responsibility to:
- secure their delivery address
- choose a collection point if necessary
- check the receipt of the parcel
Force majeure
The Seller cannot be held responsible in case of force majeure preventing the execution of the contract.
The following are considered as cases of force majeure:
- natural disasters
- pandemics
- wars
- strikes
- transport or energy interruptions
- government decisions
Property
All elements of the Clem-Tex site are protected by intellectual property law and trademark registration. Any reproduction is prohibited without permission.
Data protection
Personal data is processed in accordance with current regulations (GDPR). The Client has the right to access, rectify, and delete.
Applicable law and competent jurisdiction
These General Terms and Conditions are subject to the applicable law of the Seller's country.
In the event of a dispute, an amicable solution will be preferred. Failing that, the competent courts will be those of the Seller's registered office.
Modification of the General Terms and Conditions
The Seller reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of the order.
